General Terms and Conditions

Article 1: Definitions

  1. “Therapist” refers to Shahar Yarkoni.

  2. “Client” refers to the adult receiving therapy.

  3. “Water therapy Agreement” refers to the agreement between Shahar Yarkoni and the client.

 

Article 2: General

  1. Water therapy is not a replacement for medical treatment, medication, or regular healthcare.

  2. Shahar Yarkoni does not have diagnostic authority.

 

Article 3: Agreement | Confidentiality | Privacy

  1. Shahar Yarkoni is bound by confidentiality.

  2. Before the therapy begins, the client must complete and sign the therapy agreement, consenting to data storage.

  3. The Dutch WGBO law applies to this agreement, covering rights like access to records and confidentiality.

  4. The client consents to the use of their data as outlined.

  5. Dutch law applies to all agreements.

  6. Information may be shared with others (e.g., GP, occupational health doctor) if relevant and with written consent.

  7. In emergencies, relevant data may be shared to prevent harm.

  8. The client bears responsibility for any issues caused by withheld information.

 

Article 4: Payment Terms

  1. These terms apply to all agreements with Shahar Yarkoni.

  2. Fees are outlined in the agreement. Invoices must be paid within 14 days.

  3. Fees for contact with third parties are also outlined.

  4. Rates are adjusted yearly on January 1.

  5. Late payments may incur reminders and collection actions, at the client’s expense.

  6. In case of overdue payments, sessions may be suspended until payment is received.

 

Article 5: Cancellation

  1. If an appointment is canceled less than 24 hours in advance, Shahar Yarkoni is obliged to charge the full fee.

  2. If an appointment is canceled less than 48 hours in advance, Shahar Yarkoni is obliged to charge the 50% of the fee.

  3. If an appointment is canceled less than 72 hours in advance, there will be no charge of the fee.

 

Article 6: Crisis Support

  1. Crisis support is not available within Water Therapy. In the event of a crisis, you or your loved ones should contact your general practitioner.

  2. If urgent matters arise during the therapy period that cannot wait until the next scheduled session, it is possible to contact the therapist by phone. Please leave a voicemail clearly stating your name and phone number, and you will be called back as soon as possible.

 

Article 7: Ethical Code

  1. Shahar Yarkoni acts in accordance with the ethical code formulated by the professional association VIT.

 

Article 8: Healthcare Quality, Complaints and Disputes Act (WKKGZ)

  1. If the client believes that the water therapy was handled carelessly or improperly, a complaint can be submitted. It is important that the client first discusses and tries to resolve the issue within the practice. The VIT can also be involved. If resolution is not possible, a formal complaint can be filed.

  2. Shahar Yarkoni complies with the WKKGZ via membership in the VIT. Clients can find all necessary information about the complaints procedure through the VIT.

  3. The therapist has collective liability insurance. Any liability is limited to the amount paid out by the insurer in that specific case, plus any deductible.

 

Article 9: Liability

  1. The client behaves as a guest and adheres to the house rules set by the host (the therapist). Smoking, drinking alcohol, and drug use are not permitted during sessions. Any costs related to damage of the therapist’s property by the client will be charged to the client. Any form of assault on the therapist by the client will always be reported to the police.

  2. Shahar Yarkoni is not liable for any negative consequences resulting from the client providing incorrect or incomplete information, or withholding known and available information from medical records.

  3. Shahar Yarkoni is not liable for damage to the client’s property caused by parking on or entering the premises where the practice is located, nor for other damage incurred within the practice, hallway, or use of the toilet.

 

Article 10: Amendments and Availability of Terms

  1. The client receives the general terms and conditions as an appendix to the therapy agreement. By signing the therapy agreement, the client agrees to these terms.

Article 11: Final Provision

  1. Shahar Yarkoni may, at any time and without prior notice or justification, amend or supplement these general terms and conditions.
